The question is what would the penalty be for doing that.


Notre Dame is contractually bound to join the ACC if they join a conference before 2036 which was incorporated into the Grant of Rights. So it's possible that if Notre Dame were to join a conference other than the ACC before 2036 that their football media rights would then be assigned to the ACC until 2036, as well as them owing the full exit fee to the ACC.
